SECURE SKILLHUB: TERMS OF SERVICE & LEGAL DISCLAIMER
IMPORTANT: By registering an account, accessing course materials, or using any services on the Secure Skillhub LMS website, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
1. Proprietary Rights and Ownership
The Secure Skillhub platform, including its software, architecture, and all educational "Course Content" (videos, text, quizzes, and downloadable resources), is the sole property of Trydnt Services Limited.
- No Unauthorized Replication: You are granted a limited, non-transferable license to view and learn from the content. You shall not copy, record, download (unless explicitly permitted), or redistribute any part of the platform or its courses.
- Trademarks: The names "Secure Skillhub" and "Trydnt Services" are protected trademarks. Use of these marks without prior written consent is strictly prohibited.
2. Account Security and Individual Use
- Non-Sharing Clause: Your login credentials are for your exclusive use only. Sharing account access with third parties is a breach of this agreement and will lead to immediate account termination without refund.
- User Responsibility: You are responsible for all activity occurring under your account. You must notify us immediately of any unauthorized use.
3. Acceptable Use Policy
Secure Skillhub must be used for lawful educational purposes only. You agree not to:
- Use the site to transmit malware, viruses, or harmful code.
- Attempt to bypass or "scrape" data from the platform.
- Post or upload any content that is defamatory, infringing, or violates the Cybercrimes (Prohibition, Prevention, etc.) Act.
4. Confidentiality of Course Material
All information displayed on the platform is considered Confidential and Proprietary. This includes training methodologies, specialized security insights, and assessment data. This information is intended solely for your personal professional development and must not be used for competitive commercial activities or external training purposes without a formal partnership agreement with Trydnt Services Limited.
5. Data Protection (NDPA 2023 Compliance)
In line with the Nigeria Data Protection Act 2023, Trydnt Services Limited acts as the Data Controller.
- Purpose: We collect data (name, email, progress) only to provide educational services and certification.
- Rights: You have the right to access, rectify, or request the deletion of your personal data at any time.
- Age Limit: The platform is intended for users aged 18 and above. Users under 18 must provide verifiable parental or guardian consent.
6. Limitation of Liability and "As-Is" Provision
Trydnt Services Limited provides the Secure Skillhub LMS on an "As-Is" basis. While we strive for 100% uptime and accuracy, we do not warrant that the service will be uninterrupted or error-free. We are not liable for any technical failures, loss of data, or decisions made based on the educational content provided.
7. Governing Law
These terms are governed by the Laws of the Federal Republic of Nigeria. Any legal disputes shall be settled through arbitration or the competent courts within the Federal Capital Territory (FCT), Abuja.
Strategic Additions for Your Protection:
- Certification Validity: A clause stating that certificates are only valid if issued directly by Secure Skillhub and verified through your internal systems.
- Right to Terminate: A clause giving Trydnt the right to suspend any user who displays "abusive behavior" in community forums or towards instructors.
8. NOTICE AND TAKE DOWN PROCEDURE
In accordance with Sections 54 and 55 of the Copyright Act 2022, Trydnt Services Limited respects the intellectual property rights of others and expects its users to do the same. We have established the following procedure for addressing claims of copyright infringement:
A. Filing a Notice of Infringement
If you believe that any material available on the Secure App or Secure Skillhub LMS infringes upon your copyright, you may submit a written Notice to Take Down to our designated agent at [Insert Email Address, e.g., legal@trydntservices.com]. Your notice must include:
- A physical or electronic signature of the copyright owner or an authorized representative.
- Identification of the copyrighted work claimed to have been infringed.
- Specific identification of the infringing material on our platform (including direct URLs or specific course modules).
- Your contact information (Address, telephone number, and email).
- A statement that you have a "good faith belief" that the use of the material is not authorized by the owner or the law.
- A statement that the information in the notice is accurate, under penalty of perjury.
B. Our Response Policy
Upon receipt of a valid notice, Trydnt Services Limited will:
- Expeditiously remove or disable access to the alleged infringing content.
- Promptly notify the user/subscriber responsible for the content that a takedown has occurred.
- Notify the copyright owner once the content has been removed.
C. Counter-Notice and Restoration
If a user believes their content was removed by mistake, they may submit a written Counter-Notice to us. In line with Section 55(2) of the Act:
- We will forward the Counter-Notice to the original complaining party.
- If we do not receive a response from the copyright owner within seven (7) days indicating that legal action has been filed, we may, at our discretion, restore the removed content.
D. Repeat Infringer Policy
Pursuant to Section 56 of the Copyright Act 2022, Trydnt Services Limited maintains a strict policy to terminate the accounts of users who are found to be "repeat infringers." A repeat infringer is any user who has been notified of infringing activity more than twice and fails to provide a valid legal justification.
Why this is important for Trydnt Services Limited:
- Liability Shield: Under Nigerian law, if you don't have this published procedure, you could be held "strictly liable" for a user's infringement as if you did it yourself.
- Professionalism: It signals to corporate clients and investors that your LMS and App are built on high-standard legal frameworks.
- Conflict Resolution: It gives you a clear, step-by-step roadmap to handle disputes without immediately going to court.
